The determination of what constitutes a health hazard is not made at EPA’s level. This is something that would be done at the State level if it is done at all. EPA requires systems to conduct a sanitary survey, and the lack of implementation of a cross connection control program may be a sanitary survey deficiency, but that’s a state call. This would include hazard identification.
