A community water system exceeds the secondary maximum contaminant level (SMCL) for fluoride. Can the system provide the annual Tier 3 public notification in the consumer confidence report (CCR)?
The notice deadline for Tier 3 violations is 12 months, allowing a single annual report where applicable. Systems may choose to include this notice in their annual CCR. Community water systems that exceed the SMCL of 2 mg/l for fluoride but do not exceed the MCL of 4 mg/l must include special fluoride language in the annual report. Primacy agencies may require earlier initial notification or more frequent repeat notification on a case-by-case basis.
